TERMS AND CONDITION OF SALES
BY PURCHASING PARTS AND SERVICES FROM US, EITHER ON THE TELEPHONE OR DIRECTLY FROM THE SITE, YOU AGREE TO ALL THE TERMS AND CONDITIONS OF SALE
IN THIS SECTION. PLEASE READ THIS SECTION CAREFULLY.
RETURNS
You may exchange a defective item or a wrong part due to supplier mistake within 10 days after
receipt of the item by calling our Customer Care Department to request an RMA (Return Merchandise Authorization)
at 775-886-5300. You may not ship the part to the source or any other
destination or location without an RMA and explicit instructions to do so from our Customer Care Department. Failure to follow
the instructions will void our warranty obligation and your claim for any refunds.
RMA requests must include your name, address, email address, day and evening contact phone numbers, your
Order Number and a full description of the part deficiencies and reasons for return. Our Customer Care department
will issue an RMA number which will authorize you to ship the part back to us or the supplier.
RETURNS WITHOUT AN RMA NUMBER WILL NOT BE ACCEPTED AND WILL BE RETURNED BACK TO YOU.
The RMA number must be clearly visible on all returned merchandise packages.
We will provide the shipping address for all returned items.
We recommend packing item the part in original box and purchasing adequate insurance from the
shipper as we are not
responsible for damages or the loss that can occur during the return shipping.
Be sure to drain all fluids before packaging. Please use a shipper
that has tracking capability in order to avoid confusion and delay. If a part is being
returned due to our error, we will send a shipping label which you must use to return the package
via ground service only. In some instances,
we may choose to arrange a pick up for the part with our shippers.
When a part is received by us, it will be examined and tested to make sure that the item is the original
part and in substantially the same condition as it was shipped and that the part has not been altered and
no damage has occurred. Upon receipt, the part may be tested to ascertain that it is in fact defective.
If the part is found to be defective, at our option and based on availability, a replacement part will
be shipped to you and you will be notified of shipping date. If we are unable to replace the part, we will
refund you the amount you paid for the part. Expedited shipping charges will not be reimbursed. If we
determine that the part is not defective and it could have met your requirements, we may decline your
claim for a refund or issue a partial refund at our sole discretion. Any reference to shipping charges
on our site and in any quotations by our representatives shall be interpreted to mean as shipping,
handling and order processing charges. Returnable items sent back after 10 days for any reason, or
wrong items returned during the first 10 days due to your mistake if accepted by us at our sole
discretion, will be charged a fee of 25% of the price of the part which shall not be less than $25,
plus the shipping charges. No returns will be accepted after 30 days from the date of shipment
regardless of the reason without any exception whatsoever.
In certain circumstances, you may request a replacement part be shipped to you before we receive the part
from you. If we agree to ship a replacement part prior to receipt of a defective o part, you agree to pay
us the full price of the part plus shipping and agree that we may charge your card at our discretion at
any time for these amounts without any further notice to you. Until the first part is received and
accepted by us, you are obligated to pay for both parts. Your claim for a refund for the first part
shipped cannot be used to offset your liability for the second replacement part .
It is our policy to process your order as soon as we receive it. But while we will make every attempt
to have your order shipped to you as quickyly as possible, we will not be responsible for any delays
beyond our direct control.
Please be aware that in many instances, a used part ordered may still be on a vehicle and must be taken
off and examined and tested before shipment. We will also not be responsible for any delays caused by
the need to find a replacement for an originally intended part that is detemined to be unacceptable.
Special order items are non-returnable and non-refundable.
Returned items must be in original condition and packaging, and cannot be modified, disassembled, or damaged
by incorrect installation. Items cannot be returned due to installation or assembly errors.
Under no circumstances will we assume any liability for any damages, liabilities or any other costs borne by
you for any reason whatsoever as a result of your purchase of parts or services from us.
WARRANTIES
PartsOnNet offers a warranty with most parts
which entitles purchaser to free one-time replacement of the part during the warranty period.
Used engines, transmissions, rear ends, transfer cases, carburetors and all drivetrain components
purchased are warranted for a period of 30 to 90 days from the date of purchase depending on the type,
age and mileage as defined by the part supplier warranty policies and the length of the warranty period.
All other parts with the exception of parts sold on an AS IS basis, are warranted for a warranty period
from the supplier of the part which shall be no less than a minimum period of 30 days from the date of
purchase. Please make sure that you the know the length of warranty for the part you are purchasing as
our various suppliers have different warranty periods. Part warranty does not cover any mechanical
failures caused by abuse, damage and error in installation or assembly. If the part fails during the
warranty period, PartsOnNet at its sole discretion will replace the part or refund the amount paid for
the part excluding shipping charges.
Unless otherwise specified, we do not warrant any electrical components and parts including computers,
controllers, throttle bodies, and control modules. These parts are sold on an AS IS basis. In cases where
we offer limited warranties for these parts, the warranty on these parts is limited only to one-time
replacement of the part and does not entitle you to a refund unless we are unable to find a replacement
part for you. Most computers and controllers require reprogramming and flashing by qualified mechanics or
dealers before they will work in your car. We are not liable for any costs related to these issues.
CANCELLATION
You may cancel an order within two hours after placing an order without any penalties as long as the
order has not been shipped. We do not accept any order cancellations after two hours or after the part
has been shipped regardless of the reason. In some instances and at our sole discretion we may accept
cancellation of an order within 10 days from the date of order subject to a cancellation fee, as long
as we can assess that the part returned to us is in good working condition. All these cancellations are
subject to a %25 Part locator services and processing fees (minimum fee of $25), plus shipping charges
if the part has been shipped. Delays and errors in shipment or ordering, or mis-diagnosis of the problem
with your vehicle under any circumstances cannot be used to cancel an order.
SHIPMENT ERRORS AND WRONG PARTS
We rely on the most widely used information available in the industry to find the most commonly used
replacement part for your
vehicle based on the information you provide to us including make, model and model year of the car. This
information while sufficient in many cases does not guarantee that the replacement part sent to you will be
an identical replacement part for your vehicle. This is due to many factors including previous alterations
and customizations made to your car that you may or may not be aware of, and variations of parts used by the
manufacturer in the model year of the car. Unless you specify the replacement part you need in sufficient
detail to allow us to choose the right part, it is our policy to ship the mostly widely recognized and accepted
replacement part for your vehicle. In case the part shipped to you is not a direct replacement but is the most
commonly used replacement part for the application, you will be charged additional shipping and restocking fees
for the wrong part while we will make every attempt to find the right part for your vehicle if possible.
DISPUTES
It is our policy to resolve all disputes with our customers fairly, consistent with the terms and conditions in this section.
However, by purchasing a part or a service from us you unconditionally agree that any litigation which may arise
as a result of the transaction will be governed by the laws of the state of Nevada and may only be tried and adjudicated
in the County of Douglas in the State of Nevada.
